‘Commonwealth’ party congressional candidate: ‘Commonwealth’ “System Has Collapsed”

The 2012 congressional candidate of Puerto Rico’s ‘commonwealth’ party said February 22nd that the current governing “system of the island has collapsed” and that it needs a complete “reinvention,” according to El Nuevo Dia.
“Our model simply failed,” said Rafael Cox Alomar, who was Governor Garcia Padilla’s unsuccessful running mate for Puerto Rico’s lone seat in Congress with a vote only in committees of the U.S. House.
Puerto Rico’s governing arrangement is known as ‘commonwealth’ after a word in the official name of the territorial government, but Puerto Rico is fully subject to the U.S. Constitution’s Territory Clause and the Federal government’s related broad authority to govern territories in national and local matters. In 1952, Congress chose to grant Puerto Rico authority to organize its own local government, which States already have the power to do under the Constitution.
Cox’s political party, considered the second largest in the territory to the statehood party, is known as the ‘commonwealth’ party. It has proposed an unprecedented “Commonwealth” political status to replace the current territory status. Under the proposal, the United States would be permanently bound to Puerto Rico and to required to grant all current assistance to individuals in the islands, new assistance to the insular government, free entry of goods shipped from Puerto Rico into the States, and continued U.S. citizenship.
Puerto Rico would also be empowered to nullify the application of Federal laws and Federal court jurisdiction and to enter into international trade, tax, and other agreements and organizations requiring national sovereignty.
Federal officials under Democrats and Republican presidents, including President Obama, and congressional committees under Republicans and Democrats have rejected the proposal as impossible for constitutional and basic policy and workability reasons. The ‘commonwealth’ party officially supports the current governing arrangement until the U.S. Government can be persuaded to change its position – although there is nothing to suggest it may do so.
Cox made the statements during a speech commemorating the birth of the founder of the ‘commonwealth’ party, who engineered the Federal and insular actions for the current Federal-territorial governing arrangement, and who initially proposed some of the autonomy now advocated by the ‘commonwealth’ party. In his address, Cox took aim at the governing arrangement crafted by his party’s founder more than 60 years ago as well as at the authority for many laws enacted by Congress.
Cox called for repeal of the Puerto Rican Federal Relations Act, the basic law outlining Federal-territorial relations. He also advocated Puerto Rico’s exemption from congressional authority under the Commerce Clause.
The Commerce Clause gives Congress broad power to regulate matters affecting commerce between the States and between the U.S. and foreign nations.
Other than the fundamental rights of individuals, provisions of the U.S. Constitution apply to Puerto Rico as determined by Congress or the courts.
In 1964, a Puerto Rico Supreme Court comprised of ‘commonwealthers’ judged that the Commerce Clause did not apply in cases involving Puerto Rico, but, in 1992, the U.S. First Circuit Court of Appeals held that the Commerce Clause does apply. Last year the Puerto Rico Supreme Court changed its position, agreeing with the Federal court.
Cox Alomar also reiterated a major theme of his unsuccessful congressional campaign: that ocean shipping between the States and Puerto Rico and between Puerto Rican ports be exempted from the Federal government’s ocean cabotage laws. The laws require that the shipping be on American built, owned, flagged, and crewed vessels. The U.S. Transportation and Defense Departments, congressional leaders, and U.S. ship builders and workers have opposed exemption of Puerto Rico from the laws.
Pedro Pierluisi, who defeated Cox in 2012, has asked the U.S. Government Accountability Office, a non-partisan arm of Congress to assess the impacts on Puerto Rico and the Nation of an exemption for Puerto Rican shipping. The study is expected to be completed in the coming months.

Federal prison official slain on highway

By CB Online Staff

A supervising corrections officer who worked at Puerto Rico's lone federal prison was killed in a drive-by shooting after his shift ended, authorities said Wednesday.
Lt. Osvaldo Albarati Casana was shot late Tuesday while driving home along a busy highway Bayamon, the FBI said in a statement. The killing shut down the highway for about eight hours.
Albarati worked in the investigative branch at the Metropolitan Detention Center in Guaynabo, just west of the capital of San Juan, prosecutor Lorna Colon told reporters.
She said Albarati was responsible for investigating crime within the prison, including drug smuggling and illegal cellphone use. She said Albarati had a wife and children and previously worked for the Puerto Rico Police Department.
No one has been arrested in the killing, although the FBI said they are looking for a dark sedan with tinted windows believed to be involved in the shooting.
"We are not going to tolerate the murder of any public official in the middle of a highway," said FBI special agent in charge Carlos Cases. "We will find those responsible."

A ceremony in honor of the opening of a Russian cultural center in Puerto Rico took place in San Juan on Tuesday.

The gem of the newly opened center is its rich library which has thousands of books, including textbooks, reference books and works by Russian literary classics.
The center’s cinema house offers a wide collection of films about Russia while its computer rooms provide visitors with comprehensive information about the Russian history and culture and the country’s political and social life.
Speakers at the opening ceremony said that the center should provide Russian children adopted by Puerto Ricans with an opportunity to learn more about Russia and maintain connection with their homeland.

Swaying the Opinions of the Russian Diaspora - Heritage.org

June 21, 2012

For the first time since the collapse of the Soviet Union, the Russian diaspora is no longer viewed as necessarily anti-Communist or hostile to the Kremlin. Moscow now actively seeks to curry favor with its emigrants and make them its emissaries. Using its embassies, government websites, and a network of establishments that promote Russian language and culture, its efforts to use public diplomacy to bring the Russian diaspora back into the Russian world are growing. Intelligence experts indicate, however, that since the days of the USSR, such efforts have been closely linked to Russia’s intelligence activities, including talent-spotting, recruitment, and operations of human intelligence (HUMINT) assets.

Russia is also monitoring and manipulating its domestic social media. The government leadership understands that social networking is one of the freest modes of exchange between Russians and the outside world, and it does not want to lose control of the message that Russia is a great power.

Organizations that track global Internet freedom have documented growing intimidation from Moscow of those who are critical of the Kremlin online.[51]

Without a strategy to counteract this increasingly aggressive campaign to win hearts and minds, the United States will continue to find its own messages poorly received by Russians and its interests undermined.

PHILADELPHIA - A police officer in Philadelphia was caught on video hitting a woman in the face at the city's 50th Annual Puerto Rican Day Parade on Sunday. The video shows an officer in a white shirt hitting the woman. The blow knocks her to the ground and the officer then handcuffs her. As the woman is led away by two other officers, the video captured her bloody face. It is unclear what the woman did to provoke the officer depicts a person near the woman discharging silly string, and other parade-goers seem to be spraying water in the direction of the officers. Before she is hit, the woman appears to be holding a water bottle. Twerkcity.blogspot.com According to the Philadelphia Police Department the woman, who has not yet been identified, was arrested for disorderly conduct. Officer Tanya Little of the Philadelphia Police Department told Crimesider that the video was brought to the department's attention Monday morning and there is currently an "open and active" internal affairs investigation into the matter. Officer Little said the officer depicted hitting the woman has been identified but the department is not yet releasing his name or duty status.

Just last week, Puerto Rico’s Supreme Court upheld a law that prohibits joint adoption by gay couples.
In a 5-4 decision, the court said a woman could not adopt a 12-year-old girl whom her longtime partner conceived through in vitro fertilization. In the majority opinion the court stated a family composed of a mother and father is best for a child’s “dignity, stability and well-being.”
A few days later state senator Víctor Vassallo Anadón compared homosexuality to bestiality and pedophilia, wondering why homosexuality was not outlawed. He has since apologized but his words show a great deal of prejudice and ignorance.
As a Puerto Rican man it hurts even more—it’s personal!
Many of us who are Boricua and LGBT enjoy family support—more and more of us every day, actually. The embrace we experience from our mothers, fathers, siblings, and abuelas is won through sometimes difficult, but always profoundly moving, acts of courage. We stand before our loved ones and tell our truths and we are free to let the people we love most in the world see us as we actually are. And in knowing us, wholly and completely, we form familial bonds that are stronger and more loving because of it.
In many ways, family is THE source of our strength. I find strength in the memory of my abuela, who modeled for me how transformational truth and love can be. Growing up, I never would’ve imagined that she could have embraced me as fully as she did after I disclosed to her my sexual orientation. I know she didn’t understand it right away but she grew in her understanding and showed me as only grandmothers can, in big ways and small. She told me in the way she ran to me whenever I walked in her door, in the way she bestowed her blessing on me at the end of every phone call, “Que dios te bendiga…” “May God bless you.” In the end, it didn’t matter to my grandmother WHO I loved, it mattered THAT I loved. All she saw was the love between us. I miss her and I’m so proud of her for that.
I like to think that, someday, I could be a father and that my husband and I could share with the kids we adopt together the story about my abuela, Carmen, and her capacity to grow in love her entire life. That’s my dream. I’d love to take them for a walk on the beach in Luqillo or a hike in El Yunque and know that the beautiful island from which I can track my family’s history for generations acknowledged and respected my family – ALL OF IT! If my abuela could do it, I know that the government of Puerto Rico can do it, too.
The fact is, Puerto Rico’s Supreme Court sent a cruel message to gay people: that we’re less of value than anyone else, that our parenting skills are secondary to opposite sex couples. I’m sure their decision was based on ignorance about same-sex parents.
If Puerto Rico is truly going to have an island-wide conversation about the rights of families and pass judgment on what constitutes a family let me first suggest that those in positions of power base those judgments on facts and not myths, on love and not fear.
A large body of research consistently concludes that being raised by gay or lesbian parents has no adverse effects on children. Kids of gay parents are just as healthy and well-adjusted as other children.
It’s now up to the government of Puerto Rico to teach what the Courts obviously don’t know—that in the end, it’s only the love that counts. Let the people of Puerto Rico witness for themselves the love modeled to them by LGBT families and they’ll know the truth and be transformed by what my abuela taught me: LOVE makes a family.
