Actualmente, la Asamblea Legislativa de Puerto Rico discute, como parte de la revisión del Código Civil, la posibilidad de concederles algunos derechos y responsabilidades que tienen las parejas casadas a las parejas de hecho, tanto heterosexuales como del mismo sexo. A pesar del reconocimiento de estas uniones, el borrador del nuevo código deja intacta la institución del matrimonio como una unión estrictamente heterosexual. No obstante, la aprobación del código aún es incierta por el cabildeo que realizan tanto grupos fundamentalistas como organizaciones de derechos humanos para influir la versión final de la legislación.
El arzobispo de San Juan, Roberto González Nieves, manifestó que legalizar este tipo de uniones afectaría "la fibra moral" del pueblo puertorriqueño. Sin embargo, abogados, expertos constitucionales, profesionales de la salud y agencias gubernamentales como la Procuradoría de la Mujer, el Departamento de la Familia y el Departamento de Justicia llamaron la atención sobre las miles de parejas desprovistas de derechos por no estar casadas o por no poder hacerlo, como es el caso de las parejas del mismo sexo.
El secretario de Justicia, Roberto Sánchez Ramos, fue más allá y advirtió que, de no aprobarse el matrimonio entre personas del mismo sexo en la Isla, el Código Civil podía correr la misma suerte que el Código Penal en 2003: ser declarado inconstitucional por un tribunal estadounidense. Según el Secretario, la Legislatura debe legislar proactivamente reconociéndoles todos los derechos que tienen las personas heterosexuales a los homosexuales porque hacia esa dirección es que apuntan las últimas decisiones de los tribunales estatales y federales en los Estados Unidos. Hacer lo contrario, sería legislar contra lo que el funcionario calificó como "inevitable".
De aprobarse las uniones de hecho, Puerto Rico sería el primer país y dependencia de esta región del Caribe junto a los departamentos ultramarítimos pertenecientes a Francia, como Guadalupe, San Martín y Martinica, en reconocerles derechos a las parejas del mismo sexo.
El candidato popular a la gobernación Alejandro García Padilla dejó saber que no favorece el matrimonio entre personas del mismo sexo y defendió el matrimonio tradicional entre hombre y mujer.
"A mi juicio el matrimonio es entre hombres y mujeres. Dicho eso, no puede ser esa la excusa para discriminar contra unas personas que piensan distinto, porque tan gente es uno como otro y tan obligados estamos a defender los derechos, como los de otros", dijo el Senador popular.
Fue más allá al indicar que esto está ligado a mejorar "la calidad de vida en Puerto Rico".
"Si queremos proponer verdaderas ideas que atiendan la unidad familiar, tenemos no solo que favorecer ese principio básico del cristianismo de que el matrimonio es entre un hombre y una mujer", dijo.
García Padilla hizo las expresiones al presentar sus ideas a un grupo de personas de edad avanzada en un centro de actividades en Trujillo Alto.
Culminada la actividad, García Padilla contestó preguntas de la prensa al respecto. Fue entonces que dijo favorecer derechos a las parejas del mismo sexo, fuera del esquema de un matrimonio.
Habló de cosas básicas, como ofrecerles empleo, servicios de salud y que sus hijos tengan acceso a la educación.
"Al fin y al cabo, el derecho a la vida estaría absolutamente hueco si no le garantizaran a cada individuo el derecho a la salud y la educación", manifestó.
