*1. Puerto Rico: New Law to "Intimidate" Unions and StudentsOn July 30 Puerto Rican governor Luis Fortuño signed into law a new Penal Code that he and legislators said would counter a recent rise in crime [see Update #1111] by imposing much stiffer prison sentences for a wide range of crimes. The new law, which replaces the Penal Code of 2004, also defines the seduction of minors through the internet as a criminal offense and gives the government the power to fire any public employee who commits a crime while carrying out a public function. “We’re not going to let the criminals take over Puerto Rico,” Fortuño said at the signing ceremony.

Fortuño insisted that the new code wouldn’t limit rights of free expression. But Puerto Rican legal experts noted that the revisions dramatically increased penalties for civil disobedience. For example, participating in a protest on the steps of the Capitol building that impedes the work of Puerto Rico’s legislature—like one carried out by students in June 2010 [see Updates #1039, 1100]--could now be punished with three years in prison, while in the 2004 Penal Code the penalty only applied if legislative work was interrupted through “intimidation, violence or fraud,” language which was removed in the new law.

Attorney César Rosado, a human and civil rights specialist who represents several unions, told the Puerto Rican daily El Nuevo Día that the new law “tries to intimidate the unions and other pressure groups—like the student movement—which historically have distinguished themselves by presenting resistance to any measure they consider unjust. Establishing a three-year sentence is a big deterrent for protest.” Activists have frequently used nonviolent civil disobedience as a form of protest in Puerto Rico, most famously in the mass arrests that led to the removal of the US Navy proving grounds from the small island of Vieques in 2003. “In democracy it’s important to allow activism,” constitutional law professor Hiram Meléndez Juarbe told the newspaper, “even if at times it’s inconvenient for the government.” (END 7/30/12, 7/31/12)

In the US the maximum penalty for interrupting a session of Congress is six months in prison and/or a $500 fine. El Nuevo Día noted that the punishment for six Puerto Rican independence activists who interrupted Congress by singing patriotic hymns on May 6, 2009, was a fine. (END 7/31/12)

The American Civil Liberties Union (ACLU) filed a lawsuit on Aug. 7 challenging the new law. The challenge was presented as an amendment to a complaint the ACLU filed against the Puerto Rico Police Department on June 27 alleging that the department violated the rights of protesters [see World War 4 Report 6/28/12]. *4. Puerto Rico: Status Vote Set as Crime, Unemployment RiseOn Dec. 29 Puerto Rican governor Luis Fortuño signed a measure into law mandating a plebiscite on the island’s status, to be held on Nov. 6, the same day as the gubernatorial election. Voters will be asked two questions: whether they want to maintain the current political status, which is subject to the territorial clause of the US Constitution (Article IV, section 3); and whether as a permanent alternative they would prefer independence, incorporation into the US as a state, or the continuation of a “free associated state” status but no longer under the territorial clause. The referendum, which reflects the recommendations of a US presidential task force on Puerto Rico, is nonbinding; any changes would have to be approved by the US Congress and president.

The results of three previous plebiscites, in 1967, 1993 and 1998, were inconclusive. But opponents of the current status—principally Gov. Fortuño’s New Progressive Party (PNP), which is close to the US Republican Party, and the nationalist Puerto Rican Independence Party (PIP)—expect that both statehood and independence supporters will vote “no” on the first question and that this will force the US government to confront the status question. The Popular Democratic Party (PPD), which is close to the US Democratic Party and wants to maintain the status quo, is critical both of the plebiscite and of the decision to hold it the same day as the gubernatorial election—which is expected to benefit Fortuño when he runs for a second term. PPD vice president Héctor Ferrer told the Spanish wire service EFE on Dec. 29 that the plebiscite was a maneuver to divert attention from problems like the rising crime rate and the increase in unemployment. With a population of just 3.7 million, this year Puerto Rico had more than 1,130 homicides, a record number. Unemployment has risen to 15.2%, according to official records, while unemployment among youths from 16 to 29 is now at 30%. The situation was aggravated by the imposition of an $800 tuition surcharge for students at the University of Puerto Rico (UPR), the island’s main public institution of higher education. The increase in fees, backed by Fortuño, forced thousands of students out of the school into the job market. (Prensa Latina 12/27/11, 12/31/11)

Militant strikes by UPR students in 2010 and 2011 forced some concessions from Fortuño but were not enough to stop the $800 surcharge [see Update #1071]. However, student organizations and unions representing UPR professors and other employees won an unexpected victory on Dec. 12 when a San Juan court ruled that the university had to allow public access to information on the real estate holdings it has accumulated since its founding in 1903. While claiming that it was unable to function without the tuition surcharge, the UPR has refused to provide allow public scrutiny of its assets. As of Dec. 13 the court had not ruled on whether the university would also have to divulge information on assets other than real estate. Tampoco a aquellos que no desarrollan programas en pro del deporte puertorriqueño ni para los alcaldes que dejan las facilidades deportivas en constante deterioro, y ahora quieren posar junto a los medallistas olímpicos. Tampoco merecen reclamar esas medallas los que no tienen sentido patrio, los que nos enajenan diariamente, restringen los derechos y oprimen con sus políticas y fascismo social. Tampoco merecen esas medallas aquellas empresas que fueron mudas cuando alguien se les acercó a pedir una contribución económica. Para merecer medallas, de oro, plata y bronce, necesitamos evaluarnos como pueblo y dar la milla extra con hechos. Puerto Rico, se superara cuando pensemos, actuemos y realmente nos sintamos puertorriqueños. Es politiquería total, no habrá parcialidad en las decisiones tomadas. No permitamos que con las palabras y caras lindas de nuestros políticos nos engañen. Como estudiante de décimo grado, me preocupa mucho la limpieza de nuestras playas. El pasado 23 de junio celebramos la tradicional Noche de San Juan. Que desilusión tan grande ver al otro día nuestras playas destrozadas.
Nunca en mi vida había visto algo así. Pero, no quiero ser una más que critica la problemática, prefiero mejor ser parte de la solución. Sugiero que se desarrolle una campaña, un buen nombre sería “Jóvenes al rescate de nuestras Playas”. Donde escuelas y colegios se unan en un esfuerzo y adopten una playa por un mes.
Así ellos se darían a la tarea de ir los fines de semana y entregar bolsas de basura a los visitantes para que recojan sus desperdicios y no los dejen tirados en la arena e interactuar con los bañistas y tratar de concienciarlos de que así como ellos se toman su tiempo preparando la neverita, ‘munchies’ etc., por qué no hacer lo mismo a la hora de la salida.

El nuevo contrato de Alianzas Público Privada que este gobierno está negociando con una compañía mexicana en realidad es un regalo. Podemos comparar el dicho que le entregamos la carne y nos quedamos con el hueso.
Le estamos entregando un aeropuerto que genera ganancias de sobre $80 millones anualmente y nos quedamos con el hueso de los aeropuertos regionales que solo dejan pérdidas. Ese contrato se debe analizar e incluir todos los aeropuertos en la isla y así se sabe si en verdad los licitadores son buenos administradores y hacen cambios para que los demás aeropuertos sean remodelados y tengan más flujo de vuelos.
Le pido al gobernador Luis Fortuño que tome nota y haga lo que se hizo en la República Dominicana que se le dieron todos los aeropuertos al privatizador y no solo el de la capital, que es el que deja ganancias.

ES FALSO que el aumento de precios se debe a la alimentaria.
Si Puerto Rico cultivara sus alimentos no necesitaría de adquirirlos en el mercado internacional a precios inflados. Hoy los minoristas y mayoristas son los que ganan y los agricultores apenas sobreviven.
Necesitamos una revolución verde donde nuestros mercados estén accesibles y con justicia social.
No hay peor ciego que el que no quiere ver. Llevar bocado de alimento al estómago mañana es lo que hoy tenemos que entender. En la alimentación los monopolios extranjeros nos quitan vida y no aseguran nuestro futuro. Hoteles en nuestras tierras no producen alimentos.
Hay que luchar por tener un número de campesinos/agricultores necesarios para alimentar el resto de la población.
Puerto Rico necesita despertar, ser reaccionario y perceptivo a esta necesidad que está por venir, debido a sequías y a otros problemas en el mundo que nos suple.
La soberanía alimentaria de Puerto Rico tiene que ser parte de la política de nuestra isla.

After several years of strong migration, more Puerto Ricans now live in the fifty states than in Puerto Rico. According to the 2010 Census, there are 4.7 million Puerto Ricans living in the non-territorial United States and 3.7 million living in Puerto Rico. All states but one experienced an increase in their Puerto Rican populations between 2000 and 2010, with 300,000 additional people moving from Puerto Rico to the states between 2005 and 2009 as the territory experienced a recession.
Although Puerto Ricans remain most concentrated in the Northeast and Florida, Puerto Rican communities appear in almost every state throughout the country. For example, according to the U.S. Census Bureau’s American Community Survey from 2008 and 2009, the Puerto Rican population of Alaska grew nine percent - from 4,587 to 5,000. Texas saw one of the largest growths in its Puerto Rican populations: a 12 percent increase, from 104,564 to 115,871.
The Midwest also experienced an influx of Puerto Ricans during this time. The American Community Survey raised its estimate for Puerto Ricans in Ohio 9.4 percent, from 78,549 to 85,909 between its 2008 and 2009 estimates, an increase of 7,360 people. Over the same time period, the Puerto Rican population in Indiana grew five percent from 26,768 to , a difference of 1,333.
Populations also grew in areas already known for their strong Puerto Rican constituencies. In Florida, the state with the second-largest number of Puerto Ricans, the population grew 7.1 percent from 714,153 to 764,611, an increase of 50,458. Even in New York, which is losing Puerto Ricans to Florida and Puerto Rico, the Puerto Rican population slightly expanded between 2008 and 2009 from 1,084,417 to 1,090,272, or 0.5 percent. Connecticut had a similar story, with its population increasing by 6,395, or 2.9 percent, over the same time period (2008 to 2009).
In the South, the number of Puerto Ricans grew 12.2 percent in Virginia, up 7,165 from 58, 577 to 65,742. The population grew 8.4 percent (from 50,762 to 55,032) in North Carolina and 6.4 percent (from 53,850 to 57,277) in Georgia.
Finally, the Mid-Atlantic States have not been left out of this population growth. Delaware experienced the largest percentage increase in the region, with the Puerto Rican population growing 10 percent from 17,902 to 19,691. Pennsylvania’s Puerto Rican population also grew significantly from 312,730 to 339,222, an increase of 8.5 percent.
According to the Statistical Institute of Puerto Rico, people leaving Puerto Rico tend to be younger and more educated than those who chose to remain. This may stem from Puerto Rico’s unusually high unemployment rate, which significantly exceeds those of the fifty states and has done so for many years. Economists and others who care about Puerto Rico’s future are concerned about the impact of the Island’s “brain drain.” There is a common lament that if only Puerto Rico could finally resolve its status debate, officials could dedicate the time and attention necessary to address economic challenges and end the wave of migration from Puerto Rico.
